Will the State take your house if you don't have a Will?  Do your kids have to go to court to fight for your assets?  The word probate often sends a shiver down the spine. It actually serves an important purpose of distributing a deceased person's assets, but is widely misunderstood.  Attorney John Roth will unravel these and other myths surrounding probate at his presentations on November 1st and 4th.   

By definition, probate is the legal process by which an individual obtains court authority to manage a decedent's assets.  The Personal Representative (or Executor) is then responsible for protecting the assets, paying creditors and distributing the balance to the proper beneficiaries.  Each State has different probate laws for property within that State. John will explain the probate process specific to the State of Hawaii while going over what triggers probate, how new laws have changed the process, and why some people choose to avoid it.

Attorney John Roth is the founder of Hawaii Trust & Estate Counsel, a statewide estate planning law firm with Big Island offices in Waimea, Hilo, and Kona.  He has taught Estate Planning at the Richardson School of Law, and business law at the University of Hawaii—Hilo.
