Simply put, estate planning is the process of putting together a plan, which will allow someone to step into your shoes to manage your assets in the event of incapacity or death. In this presentation John will review the basic estate planning documents, which generally include: a will, revocable living trust (if needed), durable power of attorney and advance health care directive. The best estate plan is what an informed person decides after understanding all of their options. Estate planning is not “one-size-fits-all”; everyone has a different story and hopes for the future.

Estate Planning is necessary because, as the old expression goes, “You can’t take it with
you.” People need a will or will substitute, such as a revocable living trust, if they want to
control who inherits their property and how and when that inheritance is received, to minimize administration costs, and to avoid unnecessary taxes. A well-planned estate is a gift
to your loved ones; it’s part of your legacy. There are many misconceptions about estate planning. Circumstances vary, however, and the perfect estate plan in one person’s situation can be a terrible plan for someone else.

2024 marks John’s seventheenth year of practicing estate planning law. He is the founder of Hawaii Trust & Estate Counsel (HTEC), a law firm that focuses only on estate planning. HTEC’s main office is here in Waimea, with other offices in Hilo and Kona.
After growing up on `Oahu, John earned a B.S. degree in Business Communications from the University of Kansas (Phi Beta Kappa). He came back to the islands to pursue joint J.D. and M.B.A. degrees from the William S. Richardson School of Law and Shidler College of Business at the University of Hawai`i–Manoa. John has also taught Estate Planning as an adjunct law professor at the William S. Richardson School of Law at the University of Hawai`i–Manoa, and also speaks at seminars for lawyers and other professionals in the areas of estate planning, probate administration, law firm management, and legal ethics.
John has enjoyed being a part of the North Hawaii community for over a decade. He has served on the boards of Parker School, North Hawaii Hospice, and the West Hawaii Fund of the Hawaii Community Foundation. He is currently a member of the Donkey Mill Art Center. When not helping plan estates or fundraise for nonprofits, John enjoys painting and walking his dog Hanai.
